1955年劳工法令第60E条文“年假”

(1)雇员有权享有以下有薪年假:
(a)工作少过两年者, 每十二个月不断的服务可领取八天。
(b)工作两年但少过五年者, 每十二个月不断的服务可领取十二天。
(c)工作超过五年者, 每十二个月不断的服务可领取十六天。
*如果雇员在契约终止时工作不到十二月, 他的有薪假期享有权跟有做工月数成正比。
*如果所计算出来的年假不到一天, 少过半天将不被理会, 而超过半天者就当作一天。
*还有, 若雇员在十二个月中没有好的理由而缺勤超过十巴仙工作日的总日数, 他将无权享有年假。

(1A) 就第(1)款而言, 有薪年期是不包括休息日和有薪假期。

(1B) 如果雇员在有薪年假期或产假中生病, 该天的有薪年假是当不曾拿过。

(2)在不迟过十二个月的不断服务后, 雇主必须在不迟过十二个月内给和雇员必须拿的年假. 若雇员在此期间没有拿年假将失该年假享有权。
*不过, 在雇主要求下而雇员也同意不请年假, 雇员有权得到补年假的款项。

IR Act 1967 (Amendments) 2019

There have been calls to amend the Employment Act 1955 for some time now, and after initially posting the proposed amendments for public engagement on the website of the Ministry of Human Resources, the government is now taking steps to table the proposed amendments to this legislation in Parliament. (2A)尽管第(2)款另有规定, 在雇员服务契约终止时, 雇员有权在契约还未终止时拿所有还未拿的年假, 和该年几个月来所赚到的年假。

(3)雇主必须以平常工资率来付年假工资. 不过, 月薪雇员请年假而他该月工资没有因此减少, 他就算收到了年假工资。

(3A)如果在还未拿年假之前契约就终止时, 雇主必须付给雇员还未拿的年假的工资。
*不过, 此款将不适用在第14(1)(a)条文下被开除之雇员。

(3B) 当雇员在一段十二个月的时间拿无薪假期, 而此无薪假期一共超过三十天, 这段无薪假期将不用来计算他的服务期限。

(4) 部长可以在宪报上宣布各职业, 各工业的雇员请年假时期和给年假的方法。

*在(3A)贴文里所提到的第14(1)(a)条文:
14.特别理由终止契约
(1)因雇员行为不良而无能为工作尽责, 雇主可以在查审之后:
(a)不须通知而开除雇员

*此章不适用于此章还未施行之前, 列在工业法庭认同的团体合约之服务条件, 或任何尚有效之工业法庭指令.
